Terms of Service

Last updated: 2026-08-23

These terms are the agreement between you and [name], trading as Shotsmith, registered at Greece (ΓΕΜΗ [company number], VAT [vat]), for the use of Shotsmith.

By creating an account, buying credits or using the free trial, you accept them. If you do not accept them, do not use the service.

1. What Shotsmith does

Shotsmith takes a photograph you have taken of a physical object you own or have the right to photograph, and produces new images of that same object in a different setting. It changes the background, the lighting and the composition. It is not a stock image generator and it does not invent products.

The service is provided over the internet. There is nothing to install.

2. Who can use it

You must be at least 18, or the age of majority where you live if that is higher. If you are using Shotsmith for a business, you confirm you are authorised to bind that business to these terms.

You need one account per person. Accounts are not to be shared, sold or transferred. A business may have several people, each with their own account.

3. Your account

You are responsible for what happens under your account, including keeping your password to yourself. Tell us at hello@shotsmith.co as soon as you think someone else has access to it.

Give us accurate information when you register, and keep it current. We may suspend an account with details we cannot verify, particularly where payment or tax status depends on them.

4. Credits, plans and payment

Shotsmith is paid for in credits. A subscription grants an allowance of credits each billing period; credit packs can be bought outright on top of that.

Allowance credits expire. They are granted for a billing period and do not carry over into the next one. This is stated on the pricing page and at checkout, and it is the reason packs exist.

Pack credits do not expire while your account is open. They were bought outright.

Prices are shown exclusive of VAT unless stated otherwise. VAT is calculated at checkout according to where you are and whether you have given a valid VAT number. Prices can change; a change never applies to a billing period you have already paid for, and we will tell you before a renewal at a new price.

Failed payments. If a renewal fails we may retry it. If it keeps failing, the subscription ends, the allowance stops, and any pack credits remain.

Refunds are covered in section 6.

5. Cancellation

You can cancel a subscription at any time from your billing page. Cancelling stops the next renewal. It does not refund the period you are in, and you keep access until that period ends.

You can close your account entirely from your settings, which is also a request to erase your data — see the privacy policy.

6. If you are a consumer: your right of withdrawal

If you are buying as an individual for purposes outside your trade or profession, EU law gives you 14 days to withdraw from a purchase without giving a reason.

There is an exception, and it applies here. Shotsmith is digital content supplied immediately. When you ask us to generate an image, you are asking us to begin supplying that content before the 14 days are up. At that point you lose the right of withdrawal for the credits consumed, and you acknowledge this at checkout.

In practice this means:

  • Credits you have not used: withdrawable within 14 days, refunded in full.
  • Credits you have used: not withdrawable, because the content was supplied.
  • A subscription period in which you have generated nothing: withdrawable within 14 days of the charge.

To withdraw, email hello@shotsmith.co with your account email. We will refund within 14 days of accepting, by the method you paid with.

None of this affects your statutory rights if something is actually faulty.

7. What you may upload

You may upload photographs where you own the copyright, or have permission from whoever does, and where you have the right to photograph and commercially depict the object.

You may not upload:

  • Photographs of people, or anything where a person is identifiable, without their explicit consent.
  • Anyone else's copyrighted work, product photography or brand imagery.
  • Counterfeit goods, or goods whose sale is illegal where you are.
  • Weapons, drugs, or regulated items you are not licensed to sell.
  • Anything sexual, violent, hateful, or involving minors.
  • Anything designed to deceive — fake certifications, forged documents, falsified test results, imitations of another brand's packaging.

We may remove content and suspend accounts for breaches of this section, and we do not refund credits consumed producing content that breached it.

8. Who owns what

Your photographs stay yours. Uploading them gives us a licence to store and process them for the sole purpose of producing your images, and to keep them while your account is open. Nothing more.

The images we generate are yours. You may use them commercially: listings, advertising, packaging, print, anywhere. We claim no ownership and charge no royalty.

We do not use your photographs or your generated images to train models, and we do not licence them to anyone.

The two exceptions, both of which are yours to give or withhold:

  • Showcase. If you opt an image in, we may display it as an example of the service. You can withdraw it at any time.
  • Share links. If you create a share link, anyone with that link can see that image. You can revoke the link.

9. Accuracy, and what generated images are

Generated images are produced by machine learning models. They are not photographs of a real scene, and they can differ from your object in ways we do not intend and cannot always detect.

You are responsible for checking every image before you use it. If an image misrepresents your product — the wrong colour, an altered label, a detail that is not really there — using it commercially is your decision and your liability, not ours.

This matters most for regulated products. Where the law requires a label, allergen declaration, dosage or certification to be accurate, do not rely on a generated image to reproduce it correctly. Check it.

10. Availability

We aim to keep Shotsmith running, and we do not promise it will never be down. We may take it offline for maintenance, and we will avoid doing so at busy times where we can.

Generation depends on third-party model providers. If a provider fails, a generation may fail. Credits held for a generation that fails are released back to your balance automatically; where a partial batch succeeds, you are charged only for what succeeded.

11. Our liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected by this section.

Subject to that, and to the extent the law allows:

  • We are not liable for lost profits, lost sales, lost data, or losses that were not reasonably foreseeable.
  • We are not liable for any consequence of your using a generated image without checking it.
  • Our total liability in any twelve-month period is limited to what you paid us in that period.

12. Ending the agreement

You may stop using Shotsmith and close your account at any time.

We may suspend or close an account that breaches these terms, that we are required to close by law, or that is being used in a way that endangers the service or other customers. Where the breach is not serious, we will give you notice and a chance to fix it first.

If we close your account without cause, we refund unused pack credits and the unused part of your current subscription period.

13. Changes to these terms

We may change these terms. For a material change we will give at least 30 days' notice by email, and the change will not apply to a billing period you have already paid for. Continuing to use Shotsmith after a change takes effect means you accept it; if you do not, cancel before then.

14. Law and disputes

These terms are governed by the law of Greece, and the courts of Athens, Greece have jurisdiction.

If you are a consumer resident in the EU, this does not deprive you of the protection of the mandatory law of your own country, and you may bring proceedings there. The European Commission's online dispute resolution platform is at https://ec.europa.eu/consumers/odr.
